Terms and Conditions

Important information

These Terms govern your use of MotorhomeHire.com and our service of arranging campervan, motorhome and recreational vehicle rentals with independent rental suppliers. They form a contract between you and Motorhome Hire Limited. The vehicle rental itself is supplied under a separate rental contract between the Renter and the rental supplier.

  • A booking is confirmed only when the rental supplier confirms it. A payment receipt or an on-request acknowledgement is not confirmation.
  • At checkout, these Terms are provided through the link in the acceptance statement: “By proceeding, I accept the Booking Terms and Conditions, including the cancellation policy.” Please read the linked Terms before submitting your Booking. Selecting the acceptance box incorporates these Terms into your Booking.
  • MotorhomeHire.com does not charge a separate booking fee or card-processing fee.
  • Supplier insolvency may affect your refund. Amounts already paid to an insolvent Supplier may be refundable only to the extent recovered, subject to your mandatory legal rights. See clause 12.3.
  • Mandatory consumer rights cannot be excluded. Schedule 2 explains important Australian consumer rights.

1. Agreement and scope

1.1 The Website-use provisions of these Terms apply to your use of the Website. Our booking-service agreement begins when you submit a Booking request after accepting these Terms. The vehicle reservation becomes confirmed only as described in clause 5. If you book for other people, you must have authority to provide their information and act for them. Merely being named as a traveller or driver does not make a person liable for payment to us without their agreement or lawful authority.

1.2 You must be at least 18 years old and legally capable of entering a contract. Being permitted to make a Booking does not mean that you or another person satisfies the Supplier’s driver requirements.

1.3 These Terms (including Schedules 1 and 2), the Booking Summary and any amendment agreed with you in writing form our booking-service agreement. The Supplier Terms govern the Renter’s separate vehicle rental contract. We make the applicable Supplier Terms available before payment. Our Privacy Policy and Cookie Policy explain our handling of personal information and cookies; accepting these Terms does not replace any separate consent required by law.

1.4 The Booking Summary records the agreed price, payment amounts, dates and booking details. Schedule 1 governs Customer cancellation charges unless a different cancellation arrangement is expressly offered and agreed before you submit the Booking. Supplier Terms govern driver eligibility, collection, bonds, vehicle use, damage, roadside assistance and the rental itself. They do not increase the cancellation amounts payable under Schedule 1 or reduce our express refund obligations. Mandatory law prevails over every contractual term.

1.5 These Terms currently cover Bookings for pickup in Australia. Cancellation schedules for other pickup countries will be added before bookings for those countries become available. A schedule for one pickup country does not apply to a different country.

2. Definitions

Booking means a request or confirmed reservation for a Vehicle arranged through the Website

Booking Confirmation means our written confirmation that the Supplier has accepted the Booking

Booking Deposit means the supplier-specific amount identified as the booking deposit before you submit the Booking, including where you pay the Total Rental in full. It forms part of the Total Rental and is not an additional fee or the Supplier’s security bond

Booking Summary means the checkout summary and confirmation record identifying the Supplier, Vehicle Category, dates, locations, price, payments, selected extras and applicable policies

Customer means the person or approved business making the Booking; references to you and your have the same meaning. Driver and vehicle-use obligations also apply to the Renter and drivers under their separate Supplier Terms

Instant Confirmation means a Booking for which the Supplier’s system is expected to return an immediate confirmation

On Request means a Booking request that requires the Supplier to check and confirm availability manually

Renter means the person or business entering into the Supplier’s rental agreement for the Vehicle. The Renter may be different from the Customer

Supplier means the independent rental company identified in the Booking Summary that supplies the Vehicle and enters the rental contract with the Renter

Supplier Terms means the Supplier’s rental conditions, policies and rental agreement applying to the Vehicle and travel dates

Total Rental means the total rental price shown in the Booking Summary when the request is submitted, as subsequently amended by agreement. It includes the Booking Deposit, selected prepaid extras, selected liability-reduction products and mandatory taxes and fees included in that price. It excludes the refundable security bond, optional items purchased separately from the Supplier and variable charges arising during or after the rental

Vehicle means the campervan, motorhome, recreational vehicle or Vehicle Category described in the Booking Summary

Vehicle Category means the Supplier’s named vehicle class shown in the Booking Summary, including its confirmed seating capacity, berths and key features, subject to clause 8

Website means MotorhomeHire.com and its booking pages, customer account area and related services operated by Motorhome Hire Limited

3. Our role and the role of the Supplier

3.1 We act as a booking agent and intermediary. We search and display Supplier inventory, transmit booking information, arrange reservations, collect authorised payments, issue confirmations, process permitted amendments and cancellations, and assist communication with Suppliers.

3.2 We do not own, operate, maintain, inspect or supply the Vehicles. The Supplier is responsible for providing the Vehicle, conducting depot procedures, checking driver eligibility, taking any security bond, providing roadside assistance, maintaining the Vehicle and performing the rental contract.

3.3 The rental contract is between the Renter and the Supplier. We are not a party to that rental contract merely because we collect money or assist with a complaint. Nothing in these Terms excludes responsibility for our own booking service, negligence, misleading conduct or other liability that applicable law does not permit us to exclude.

3.4 We may receive commission or other remuneration from a Supplier. This does not change the Total Rental shown and accepted at checkout.

4. Search results, prices and availability

4.1 Search results use information received from Supplier booking systems and availability feeds. Displayed availability and prices may change before you submit a request. If the Supplier cannot confirm the price or category requested, we will ask you to accept any proposed change or provide a full refund under clause 5.3.

4.2 We display whether a Vehicle is expected to be available for Instant Confirmation or is On Request. We use reasonable care when presenting Supplier information, but a feed delay, transmission failure or obvious error may occasionally affect a displayed price, feature or availability.

4.3 Before payment, the Booking Summary identifies the Supplier and Vehicle Category, transaction currency, Total Rental, Booking Deposit component, amount payable immediately, selected extras, remaining balance, who collects it and its due date or payment timing. Checkout provides a link to these Terms, including Schedule 1. The cancellation schedules are contained on the linked Terms page. You must check your details and accept these Terms before submitting the Booking.

4.4 Australian consumer prices include applicable GST and unavoidable fees that can be calculated for the selected Booking. MotorhomeHire.com does not add a separate booking fee or card-processing fee. A security bond, optional purchase or variable charge for matters such as fuel, cleaning, tolls or damage is separate where disclosed in the Supplier Terms. Any Supplier payment charge that is unavoidable and can be calculated in advance must be included in the displayed total.

4.5 If a genuine and obvious pricing error materially affects the Total Rental, we may, acting reasonably and in good faith and to the extent permitted by law, decline or cancel the Booking before pickup, including after confirmation or payment. An obvious error is one a reasonable customer would recognise as a mistake. A low price alone does not establish an error; genuine discounts, valid promotions and later price increases are not pricing errors. We will promptly explain the error and, if we decline or cancel the Booking, refund all amounts we collected, including the Booking Deposit, without cancellation or refund fees. Any corrected price requires your agreement. For content errors identified before confirmation, you may accept the correction or receive a full refund. Otherwise, we will not increase a confirmed rental price without your agreement, except for an applicable tax or mandatory government charge that the law permits to be passed on. Separately disclosed variable charges arising from your use of the Vehicle remain governed by the Supplier Terms. Your mandatory consumer rights, including any right to compensation, remain unaffected.

5. Booking formation

5.1 Instant Confirmation bookings

An Instant Confirmation Booking is confirmed only when the Supplier accepts the Booking and our system records that acceptance. We will then send the Booking Confirmation. A payment authorisation or receipt by itself does not confirm the Booking.

5.2 On Request bookings

An On Request submission instructs us to seek the Supplier’s confirmation and begins our booking service. We may collect the amount shown at checkout when you submit the request, but the vehicle reservation is confirmed only when the Supplier accepts it. We will seek a response promptly and keep you informed of a delay. We must perform our booking service within any timeframe agreed with you or, if none is agreed, within a reasonable time.

If you withdraw an On Request submission because you change your mind or plans, clause 10 and Schedule 1 apply. Withdrawal is not automatically free merely because Supplier confirmation has not yet arrived. This does not remove your right to a refund if we cannot obtain confirmation, cannot provide our service within the agreed or a reasonable time, or applicable law gives you a cancellation or refund right.

5.3 If the requested Vehicle is unavailable

If the Supplier cannot confirm the requested Vehicle Category at the agreed price, we may offer an alternative for your approval. You may accept it or receive a full refund of all amounts we collected for the unconfirmed request. We will not substitute a different booking without your agreement. Refunds are returned promptly to the original payment method where possible; the payment provider and card issuer control when the credit appears in your account.

5.4 Pricing errors affecting confirmation

A confirmed Booking remains subject to the limited pricing-error provisions in clause 4.5. Payment collection, Supplier acceptance or the issue of a Booking Confirmation does not remove those provisions.

6. Customer information and responsibilities

6.1 You must provide complete and accurate contact, traveller, driver, age, licence, residency, pickup, drop-off and payment information. You must promptly review the Booking Confirmation and notify us of an error.

6.2 You are responsible for checking that the Vehicle Category, number of legal travelling seats, berths, features, locations, dates, operating hours, luggage capacity and restrictions are suitable for your trip.

6.3 You must comply with the Supplier Terms and all laws applying to driving and using the Vehicle. You must not make a speculative, fraudulent or unauthorised Booking or use another person’s payment method without permission.

6.4 If the Supplier refuses collection because you supplied incorrect information or fail to meet driver, identification, payment-card or security-bond requirements made available before booking, the refusal may be treated as a Customer cancellation or no-show under Schedule 1. This does not apply to the extent the problem was caused by our or the Supplier’s error, an undisclosed requirement, or circumstances giving you a remedy under mandatory law.

7. Driver licence and security bond requirements

7.1 Driver age, licence tenure, licence class, translation, international driving permit, identification, security bond and card requirements vary by Supplier, Vehicle and pickup jurisdiction. The applicable Supplier Terms govern those requirements.

7.2 The person making the Booking must be at least 18, but a Supplier may require drivers to be older or impose a young-driver condition or charge. You must check the Supplier Terms before payment.

7.3 A security bond is not the Booking Deposit. It is normally authorised, held or charged by the Supplier at pickup and released or refunded under the Supplier Terms. MotorhomeHire.com does not control the Supplier’s bond release or a bank’s processing time.

8. Vehicle category, images and substitution

8.1 Your Booking is for the displayed Vehicle Category. Photographs and example makes, models, layouts and years illustrate that category; the individual fleet vehicle may vary. This does not permit a material departure from confirmed category features or any particular specification expressly guaranteed in your Booking Summary.

8.2 If the booked Vehicle Category is unavailable, the Supplier may provide a substantially equivalent vehicle at no higher rental price. It must have at least the confirmed number of legal travelling seats and berths, broadly equivalent included bathroom and kitchen facilities, an equivalent transmission type and the same or a higher general category. It must also meet any expressly confirmed essential requirement, such as four-wheel drive, child-restraint compatibility or an accessibility feature.

8.3 If no substantially equivalent vehicle is available, you may accept another vehicle, credit or other arrangement offered to you, or cancel and receive a full refund of the amounts we collected under clause 12, subject to the Supplier insolvency exception in clause 12.3. We will not require you to accept a materially different vehicle. This does not limit any greater remedy required by law.

9. Payments

9.1 Depending on the Supplier and booking timing, we collect a Booking Deposit, partial payment or full Total Rental. The Booking Deposit varies by Supplier. Where you pay in full, the separately identified Booking Deposit component is included within that payment; paying in full does not make the entire payment a Booking Deposit.

9.2 The Booking Summary states whether the remaining balance is payable to us or directly to the Supplier, its amount and currency, and the due date or payment timing. We commonly collect balances around 35 days before pickup, but the date shown for your Booking governs. A Booking made close to pickup may require full payment immediately. A balance paid directly to the Supplier may be payable in the Supplier’s local currency even if your payment to us was in another currency.

9.3 By submitting the Booking and providing an authorised payment method, you authorise us, through our payment provider, to retain and use a tokenised payment credential to charge the remaining balance payable to us on the date disclosed before payment. You also authorise us to charge lawful cancellation amounts calculated under clause 10 and Schedule 1, after the notice required by clause 10.5. Any additional payment for an amendment requires your agreement. The authorisation is limited to amounts lawfully due. We do not store your complete card number or security code.

9.4 The Booking Confirmation repeats the balance amount, currency, due date and collection arrangements. If a payment fails, we will notify you and provide a reasonable opportunity to resolve it, taking account of the disclosed Supplier payment deadline and time remaining before pickup. If it remains unpaid, the Booking may be cancelled and Schedule 1 may apply. We will not collect the same amount twice.

9.5 Payments to us are processed in the transaction currency selected and shown before payment, which may include AUD, NZD, USD, GBP or EUR. AUD is the default for Australian pickups. Our quoted currency conversion uses our own rate, which may differ from an interbank or published market rate. Your bank may impose its own conversion or international-transaction fee, including where a payment in your card’s currency is processed by an overseas merchant. We do not charge or control those bank fees.

9.6 Card statements may identify the merchant as MotorhomeHire.com or Motorhome Hire Limited.

9.7 Where a fixed Australian-dollar cancellation charge or minimum in Schedule 1 is payable in another currency, we use our conversion rate for the Booking’s transaction currency at the time you submitted the Booking request. That rate is fixed for those charges and minimums. Percentage charges use the Total Rental in the relevant transaction currency. The calculation will state the rate used, credits for payments already made and the resulting amount due, at least 24 hours before collection. Any conversion must be applied consistently so that the Schedule 1 cap and payment credits are preserved.

10. Cancellations by the Customer

10.1 How to cancel

You must submit a cancellation through your booking-management account or email bookings@motorhomehire.com, quoting your Booking reference. A cancellation takes effect when we receive the written request, using the pickup depot’s local time; a later acknowledgement or processing delay does not move it into a higher fee band. You should not rely solely on contacting the Supplier because the Supplier may not be authorised to calculate or process our cancellation amounts.

If the Supplier accepts your cancellation directly, notify us promptly so we can reconcile the payments. We will use the earlier documented time at which we or the Supplier received the cancellation, and will not duplicate a charge already paid to the Supplier.

10.2 Applicable policy

The applicable cancellation schedule is the one for your pickup country and Supplier or brand in Schedule 1. If no brand-specific schedule is listed for that country, that country’s Default Cancellation Schedule applies. The version accepted when you submitted your Booking request governs, including while an On Request submission awaits confirmation. A later Supplier policy or webpage change does not increase your existing cancellation liability. We will not add an unlisted higher Supplier cancellation charge to the applicable schedule.

10.3 Booking Deposit and additional cancellation charge

Except as otherwise provided by these Terms, the applicable cancellation schedule or mandatory law, the Booking Deposit is non-refundable when you cancel. In addition, you must pay the brand-specific or default cancellation charge that applies under Schedule 1.

Any percentage-based additional cancellation charge is calculated by reference to the Total Rental. Amounts already paid are applied to the total cancellation liability, and the total amount retained or charged for cancellation will not exceed 100% of the Total Rental.

If mandatory law requires a lower amount or a different remedy, the cancellation liability is reduced or adjusted to the extent required by that law.

For example, if the Total Rental is $1,000, the Booking Deposit is $200 and the applicable additional charge is 50% of the Total Rental, the total cancellation liability is $700. If the applicable schedule is 100%, the total cancellation liability is capped at $1,000 and the $200 already paid is credited towards it.

10.4 Timing rules

The timing rules in Schedule 1 apply. Most bands use calendar days at the pickup depot. Where a brand schedule specifies 24 hours or less, that actual-hours cut-off takes priority over an overlapping calendar-day band. Moving travel dates does not reset or avoid a cancellation period. If you cancel an amended Booking on or after the original or earliest confirmed pickup date used under Schedule 1, the pickup-day cancellation band applies, subject to any lower amount or other remedy required by mandatory law.

10.5 Automatic collection

Before collecting an outstanding cancellation amount, we will email the applicable schedule, calculation, currency, payment credits and amount due at least 24 hours before charging your tokenised payment credential. Tell us promptly if you identify an error; we will investigate a genuine calculation error before collecting the disputed amount. This does not restrict lawful cardholder disputes or mandatory consumer rights. We do not charge a fee merely because you raise a card dispute.

10.6 Unused days

After pickup, refunds for late collection, early return or unused rental days are governed by the Supplier Terms and the applicable cancellation schedule. Unless those terms or mandatory law provide otherwise, no refund is payable merely because the Vehicle is collected late or returned early.

11. Amendments

11.1 An amendment is subject to Supplier approval, availability, current pricing and any Supplier amendment fee. We do not guarantee that the same Vehicle Category, price or promotion will remain available.

11.2 A reduction in rental duration or value does not automatically reduce the Booking Deposit. Any revised price, deposit treatment or other financial effect will be explained before you agree to the amendment. An increase must be paid as agreed.

11.3 A change of Vehicle Category, pickup location, drop-off location or travel dates may be treated by the Supplier as cancellation and rebooking. We will disclose the known financial effect before processing the requested amendment.

12. Cancellation or non-supply by the Supplier

12.1 If the Supplier cancels, becomes insolvent or cannot provide the confirmed Vehicle, we will use reasonable efforts to offer a substantially equivalent alternative without increasing the agreed rental price.

12.2 You may accept a substantially equivalent alternative. If none is available, or the alternative offered is materially different and you do not accept it, we will refund all amounts we collected for the affected Booking, including the Booking Deposit, subject to the Supplier insolvency exception in clause 12.3. A credit is optional and will not replace a refund due under these Terms or mandatory law. Customer cancellation charges under Schedule 1 do not apply when the Supplier cancels or cannot supply and you exercise a refund right under this clause 12.

12.3 If the Supplier cannot provide the confirmed rental because it is insolvent, we do not guarantee repayment from our own funds of amounts we have properly paid to that Supplier for your Booking and not recovered from it. We will refund the portion of your payments that we have not paid to that Supplier. We will take reasonable steps to recover the balance, keep you informed and promptly pass on any recovery relating to your Booking. Customer cancellation charges under Schedule 1 do not apply in these circumstances.

12.4 The refund arrangements in clauses 12.2 and 12.3 cover payments collected by MotorhomeHire.com. We do not guarantee reimbursement of money you paid directly to the Supplier. Claims for those direct payments must be made to the Supplier or its insolvency administrator, and we will assist communication. Nothing in this clause 12 excludes responsibility for our own breach, negligence, misleading conduct or mishandling of funds, limits any remedy mandatory law requires us to provide, or restricts lawful cardholder dispute rights.

12.5 Separately booked flights, accommodation and activities are not included in the refund arrangements in clauses 12.2 and 12.3. Your rights to compensation under applicable law remain unaffected. Consider travel insurance suitable for cancellation, interruption and additional travel expenses.

13. Events outside reasonable control

13.1 Flood, fire, cyclone, severe weather, road closure, epidemic, pandemic, war, civil disturbance, industrial action, government restriction, utility or communications failure and similar events may prevent or materially affect travel or performance.

13.2 If an event prevents the Supplier from providing the confirmed Vehicle at pickup, clauses 8 and 12 continue to apply. For disruption during the rental, the Supplier Terms and mandatory law govern the rental remedy. If the Supplier can provide the booked rental but your own travel plans are disrupted and you cancel, Schedule 1 applies unless these Terms or mandatory law entitle you to a different outcome. We will assist communication with the Supplier.

13.3 A recommendation to obtain travel insurance is not a representation that a particular policy will cover an event. MotorhomeHire.com does not sell travel insurance or provide insurance advice.

14. Liability reduction products and travel insurance

14.1 A Supplier may offer an optional liability-reduction, excess-reduction or protection product. These products alter the amount for which the Supplier may hold you responsible under the rental contract. They may have important exclusions and should not be assumed to be comprehensive insurance.

14.2 The Supplier provides and administers these products. You must read the Supplier Terms describing the daily price, liability or excess, security bond, inclusions, exclusions and claims process.

14.3 MotorhomeHire.com does not independently insure the Vehicle, sell separate rental-vehicle excess insurance or sell comprehensive travel insurance. General explanations on the Website are not personal financial or insurance advice.

15. Lowest price guarantee

15.1 The lowest price guarantee is available only before you submit a Booking request, including an On Request submission. If you find a lower eligible price, contact support@motorhomehire.com so we can verify and adjust the price before you book. The guarantee does not provide a retrospective refund, credit or adjustment once your request has been submitted.

15.2 A competing price is eligible only if it is publicly displayed, immediately bookable and available to the same Customer at the time we verify it. It must match the same Supplier, Vehicle Category, pickup and drop-off dates and times, locations, transaction currency, inclusions, kilometre allowance, selected liability option, payment schedule and cancellation conditions.

15.3 Membership rates, loyalty rates, coupon or promotional-code rates, corporate and travel-agent rates, package prices, opaque or unnamed-supplier offers, negotiated rates, pricing errors and offers not available to the general public are excluded.

15.4 If the price qualifies and remains available, we will offer a price adjustment before Booking. Availability may change while a claim is reviewed. The guarantee does not require us to match an offer that is no longer bookable when verified.

16. Promotions and promotional codes

16.1 A promotion or code is subject to its stated travel dates, booking dates, eligible Vehicles, minimum rental period and other conditions. Unless stated otherwise, promotions cannot be combined, transferred, exchanged for cash or applied retrospectively.

16.2 A Supplier may withdraw a promotion for future bookings or close availability. A valid promotion already incorporated into a confirmed Booking will not be removed merely because the promotion later ends.

17. Pickup, vehicle use and return

17.1 Pickup and return procedures, operating hours, required identification, briefings, fuel, kilometres, cleaning, tolls, pets, smoking, prohibited roads, geographic restrictions, equipment, breakdowns, accidents, damage and late return are governed by the Supplier Terms.

17.2 You must inspect the Vehicle at pickup, record visible damage as instructed and raise any material discrepancy with the Supplier before departure. If a substitute is materially different from the confirmed category, contact us promptly before accepting it where reasonably possible.

18. Breakdowns, accidents and roadside assistance

18.1 During the rental, contact the Supplier’s roadside-assistance or emergency number first for a vehicle problem and follow its reasonable instructions. In an emergency, prioritise safety and contact emergency services where needed. Repairs, towing or abandonment without Supplier approval may not be reimbursed unless the circumstances or applicable law justify them.

18.2 MotorhomeHire.com can help communicate with the Supplier but does not operate the roadside service, authorise repairs, assess vehicle damage or independently determine compensation under the rental contract.

18.3 Refunds or credits arising from breakdown, vehicle quality or disruption are determined under the Supplier Terms and mandatory consumer law. If the Supplier provides a refund through us, we will pass on the amount received that is payable to you.

19. Complaints

19.1 For a problem during the rental, first use the Supplier’s roadside-assistance or depot contact so the Supplier has an opportunity to address it. Keep photographs, receipts, messages and other relevant evidence.

19.2 Send complaints about our booking service or unresolved Supplier issues to complaints@motorhomehire.com. Include the Booking reference, a clear description, supporting material and the outcome requested. We aim to acknowledge a complaint within one business day, although investigation may take longer.

19.3 We will assist communication with the Supplier. Our role in a Supplier compensation claim does not remove our own refund obligations under these Terms or responsibility for our own breach. Otherwise, we do not independently assess vehicle damage claims or pay compensation owed solely under the Supplier’s rental contract, except where required by law.

20. Customer accounts

20.1 Your customer account allows you to view your Booking details and submit a cancellation under clause 10.1. You may also cancel by emailing bookings@motorhomehire.com. Send amendment requests to the same email address. Protect your account credentials, keep contact details accurate and notify us promptly of suspected unauthorised access.

20.2 We may suspend access where reasonably necessary to investigate fraud, protect the Website or enforce these Terms. Suspending account access does not cancel a Booking or remove payment obligations unless we confirm otherwise.

21. Acceptable use of the Website

You must not use the Website to break the law, commit fraud, interfere with security or operation, introduce malicious code, scrape or extract data at scale without permission, reverse engineer protected systems, impersonate another person, infringe intellectual property or privacy rights, make abusive or threatening communications, or attempt to book outside authorised channels to avoid applicable terms or payments.

22. Intellectual property and third party links

22.1 MotorhomeHire.com, its software, design, text, databases and original content are owned by or licensed to Motorhome Hire Limited. Supplier names, logos, vehicle photographs and other Supplier materials belong to their respective owners or licensors.

22.2 You may use the Website for personal booking and travel planning, or for approved travel-agent and corporate bookings under clause 29. You may not commercially reproduce, republish, distribute or otherwise exploit protected content without permission.

22.3 Third-party links are provided for convenience. We are not responsible for an external website’s content, security or separate terms, except to the extent applicable law imposes responsibility.

23. Privacy, fraud prevention and communications

23.1 We handle personal information in accordance with our Privacy Policy and use cookies and similar technologies in accordance with our Cookie Policy. These policies explain our use of booking records, emails, live chat, acceptance logs, IP addresses, fraud-screening results, Supplier communications and session-replay or analytics tools.

23.2 We share information reasonably necessary for the Booking with the selected Supplier and relevant payment and service providers, as explained in the Privacy Policy and permitted by law. Where a particular use requires separate consent, accepting these Terms alone does not supply that consent.

23.3 Transactional communications about a Booking are necessary to provide the service. Marketing consent is separate and optional, and you may withdraw it using the unsubscribe method provided.

24. Website service and liability

24.1 We will provide our booking service with reasonable care and skill. We do not promise that the Website will always be uninterrupted, free from every error or compatible with every device.

24.2 The Supplier, not MotorhomeHire.com, is responsible for the rental Vehicle and performance of the rental contract. To the extent permitted by law, we are not liable for a Supplier’s independent act or omission merely because we arranged the Booking, but we remain responsible for our own acts and obligations.

24.3 To the extent permitted by law, neither party is liable to the other for an indirect or consequential loss that was not reasonably foreseeable when the contract was made. This does not exclude liability for fraud, wilful misconduct, death or personal injury caused by negligence, an obligation to refund or pay money under these Terms, or any liability that cannot lawfully be excluded or limited.

24.4 Where applicable law permits and it is fair and reasonable to do so, our liability for a failure in our booking service is limited, at our option, to supplying the service again or paying the reasonable cost of having it supplied again. This does not limit any liability or payment obligation preserved by clause 24.3. Where the Australian Consumer Law applies, this limitation does not apply to a breach of a consumer guarantee for services of a kind ordinarily acquired for personal, domestic or household use or consumption.

25. Customer responsibility for loss

You are responsible for direct and reasonable loss we suffer because of your fraud, deliberate unlawful conduct or material breach of these Terms. You are not responsible to the extent the loss was caused by us, a Supplier or another person, or to the extent an indemnity or recovery would be unfair or prohibited by law.

26. Changes to these Terms

26.1 We may update these Terms for future Website use and future Booking requests. The version accepted when you submit a request continues to govern that Booking, including its cancellation. Changes apply to an existing Booking only if required by law, if they benefit you, or if expressly agreed with you and lawful.

26.2 We will identify the effective date and version identifier of the current version. A material change will not be applied retrospectively merely by publishing it on the Website.

27. Dispute resolution, governing law and jurisdiction

27.1 Before commencing court proceedings, you and we must give written notice of the dispute and allow a reasonable opportunity to resolve it through complaints and good-faith negotiation. Either party may proceed if the other does not respond or the dispute remains unresolved after that reasonable opportunity. This does not prevent urgent relief, preservation of a limitation period, a lawful cardholder dispute, or contact with a regulator, tribunal or consumer-protection body where a mandatory right applies.

27.2 These Terms and our booking service are governed by the laws of Hong Kong SAR. The courts of Hong Kong SAR have non-exclusive jurisdiction.

27.3 Clauses 27.1 and 27.2 do not deprive a consumer of mandatory rights, remedies or access to a court or tribunal that applicable law does not permit the parties to exclude or restrict.

28. General terms

28.1 If a provision is invalid or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions will continue.

28.2 A delay in enforcing a right is not a waiver. A waiver must be clear and applies only to the circumstance for which it is given.

28.3 You may not transfer a confirmed Booking or your rights without our and the Supplier’s written approval. We may transfer our agreement as part of a genuine corporate reorganisation or business transfer if this does not materially reduce your rights, and we will provide reasonable notice.

28.4 Except where expressly stated, no third party may enforce these Terms under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) or otherwise.

28.5 These Terms do not create employment, partnership or joint venture between you, us or a Supplier.

28.6 English is the governing version of these Terms to the extent permitted by law. A translation is provided for convenience. If a translated version conflicts with the English version, the English version prevails unless applicable law requires otherwise.

28.7 Notices concerning a Booking may be sent electronically to the email address or account associated with it. You must keep those details current.

29. Approved travel agents and corporate accounts

29.1 These consumer Booking Terms are not the complete commercial agreement for an approved travel agent making bookings for resale or an approved corporate account arranging employee travel. Those accounts must operate under a separate written trade or corporate agreement.

29.2 The separate agreement prevails to the extent of a conflict. Consumer protections continue to apply to an end traveller where the law gives that traveller rights that cannot be excluded by the trade arrangement.

Schedule 1: Cancellation charges

This Schedule states the additional cancellation charges that may apply. For your pickup country, the listed Supplier or brand-specific schedule applies; otherwise, the Default Cancellation Schedule applies. Unless these Terms or mandatory law require otherwise, the Booking Deposit is non-refundable when you cancel and is retained in addition to the stated charge. Where no additional charge is stated for the relevant period, only the Booking Deposit is retained. Total cancellation liability is capped at 100% of the Total Rental, including any fixed minimum. Payments already made are credited against that liability, and any excess is refunded.

Cancellation periods are calendar days calculated using local time at the pickup depot, except where a 24-hour cut-off is expressly stated. The original or earliest confirmed pickup date and its associated time apply after an amendment (see clause 10.4). For an unconfirmed On Request booking, use the requested pickup date and time. For Australian pickups, ‘$’ means AUD; clause 9.7 applies to currency conversion.

Part A: Australia

This Part applies only to pickups in Australia. Percentages are calculated on the Total Rental.

Schedule 2: Australia consumer terms

AU1. These Terms do not exclude, restrict or modify any consumer guarantee, remedy or other right under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

AU2. Where the Australian Consumer Law applies, services come with guarantees including that they will be provided with due care and skill, will be fit for a purpose made known in circumstances where the guarantee applies, and will be supplied within a reasonable time where no time is fixed.

AU3. If our booking service has a major failure, you may have a right to cancel the service contract and receive a refund for the unused portion, or retain the service and recover compensation for its reduced value. You may also be entitled to compensation for reasonably foreseeable loss caused by a failure. For a non-major failure, we may be entitled to remedy it within a reasonable time. Supplier failures and rental remedies are also subject to the Australian Consumer Law where it applies.

AU4. Prices for Australian pickups default to AUD and include applicable GST and unavoidable fees that can be calculated for the selected Booking. MotorhomeHire.com does not charge a separate card-processing fee or booking fee.

AU5. The choice of Hong Kong law and jurisdiction does not prevent an Australian consumer from exercising a mandatory right or remedy available under Australian law.
